### 1. Definitions, Purpose & Vision
"The Software" refers to the qgate source code, documentation, simulation
data, examples, and all associated files distributed in this repository.
The Software is released under this Source Available License to foster
academic reproducibility, peer review, and transparent benchmarking of
time-symmetric trajectory filtering on Noisy Intermediate-Scale Quantum
(NISQ) hardware.
### 2. Permitted Uses (Copyright Grant)
You are granted a worldwide, royalty-free, non-exclusive, non-transferable
copyright license (without the right to sublicense) to use, copy, modify,
and redistribute the Software strictly for the following purposes:

Publishing papers, running experiments, and open benchmarking of
quantum hardware.
!!! success "Internal Corporate Evaluation"
Engineers and researchers at commercial entities may use the Software
internally to evaluate its performance. This explicitly includes the
right to execute the Software on third-party cloud hardware (e.g.,
IBM Quantum, AWS Braket) strictly for internal R&D, and the right to
redistribute the Software internally within the same legal entity.

Patent rights are governed separately under Section 5.
### 3. Commercial Use Restrictions
To sustainably fund the ongoing R&D of this architecture, **commercial
deployment requires a separate commercial license.** You may not use this
Software or its derivatives for:

Integrating the Software into commercial Quantum-as-a-Service (QaaS)
platforms, cloud APIs, or proprietary hardware control stacks offered
to third parties.

Bundling the Software into paid enterprise error-suppression, quantum
middleware products, or proprietary benchmarking services.
### 4. Redistribution & Modification
If you redistribute the Software or any modifications/derivatives thereof,
you must:
- Include a copy of this License.
- Retain all copyright, patent, and attribution notices.
- Distribute any modifications under this exact same License.
### 5. Patent Rights & Intellectual Property
This Software implements methods covered by pending patent applications:
- **US App. No. 63/983,831**
- **US App. No. 63/989,632**
- **Israeli App. No. 326915**
- Any associated continuations, non-provisional filings, or foreign counterparts.
For **Permitted Uses** (Section 2): non-exclusive, non-transferable,
royalty-free patent license strictly limited to non-commercial research
and internal corporate evaluation.
For **Commercial Uses** (Section 3): **no express or implied patent license
is granted.**
### 6. Termination
Any violation of the commercial restrictions (Section 3) or redistribution
conditions (Section 4) results in **automatic and immediate termination**
of this License, including revocation of any patent grants.
